1.attheendofrecital5,thefollowingshallbeadded:

Itscrutinyisnecessaryasregardstofollowmeasurestheregulatoryofgeneralprocedurescopewhichwithseekinstrumenttoamendnon-essentialprocedureinterreferredadoptedtoininArticleaccordanceelementsof251ofthewithabasicthesupplementingaliabydeletingnonessentialtheinstrumentsomeofbythosetheadditionelementsTreaty,oforbythesuchtwoelements.Thisprocedureshouldenablenewelementsmeasuresarmsofthelegislativeauthoritytoscrutinisethelegislatorofabeforetheyareadopted.TheessentialonlegislativethebasisactofmaytheonlyTreaty;be’;

amendedby3.recital(10)shallbereplacedbythefollowing:

orpresentmaysubmitalegi-(d)ifittheParliament.shallCouncilwithoutenvisagesadoptingtheproposedmeasures,monthIfthedelayCouncilsubmitthemtotheEuropeansubmitperiod,theCommissiondoesnotshallactwithinthetwo-Parliament;

(e)theEuropeanParliament,actingbyamajorityofitscomponentmemberswithinfourmonthsfromtheforwardingoftheproposalinaccordancewithpoint(a),mayopposetheadoptionofthemeasuresinquestion,justifyingtheiroppositionbyindicatingthattheproposedmeasuresexceedtheimplementingpowersprovidedforinthebasicinstrumentorarenotcompatiblewiththeaimorthecontentofthebasicinstrumentordonotrespecttheprinciplesofsubsi-diarityorproportionality;

Commissionshalladoptthemeasures,whichshallimme-diatelybeimplemented.TheCommissionshallwithoutdelaycommunicatethemtotheEuropeanParliamentandtotheCouncil;

(f)if,withinthatperiod,theEuropeanParliamentopposestheproposedmeasures,thelattershallnotbeadopted.Inthatevent,theCommissionmaysubmittotheCommitteeanamendeddraftofthemeasuresorpresentalegislativeproposalonthebasisoftheTreaty;

(b)withinatime-limitofonemonthfollowingthatcommu-nication,theEuropeanParliament,actingbyamajorityofitscomponentmembers,ortheCouncil,actingbyaqualifiedmajority,mayopposethemeasuresadoptedbytheCommission,onthegroundsthatthemeasuresexceedtheimplementingpowersprovidedforinthebasicinstrumentorarenotcompatiblewiththeaimorthecontentofthebasicinstrumentordonotrespecttheprinciplesofsubsidiarityorproportionality;

(g)if,onexpiryofthatperiod,theEuropeanParliamenthasnotopposedtheproposedmeasures,thelattershallbeadoptedbytheCouncilorbytheCommission,asthecasemaybe.

5.Bywayofderogationfromparagraphs3and4,abasicinstrumentmayindulysubstantiatedexceptionalcasesprovide:

(c)intheeventofoppositionbytheEuropeanParliamentortheCouncil,theCommissionshallrepealthemeasures.Itmayhoweverprovisionallymaintainthemeasuresinforceifwarrantedonhealthprotection,safetyorenvi-ronmentalgrounds.Inthatevent,itshallwithoutdelaysubmittotheCommitteeanamendeddraftofthemeasuresoralegislativeproposalonthebasisoftheTreaty.Theprovisionalmeasuresshallremaininforceuntiltheyarereplacedbyadefinitiveinstrument.’.

8.InArticle7(3)attheendofthefirstsentence,thefollowingshallbeadded:

(a)thatthetime-limitslaiddowninparagraphs3(c),4(b)and4(e)shallbeextendedbyanadditionalmonth,whenjustifiedbythecomplexityofthemeasures;or

‘followingarrangementswhichensurethatthetransmissionsystemistransparentandthattheinformationforwardedandthevariousstagesoftheprocedureareidentified.’.

(b)thatthetime-limitslaiddowninparagraphs3(c),4(b)and4(e)shallbecurtailedwherejustifiedonthegroundsofefficiency.

ThisDecisionshalltakeeffectonthedayfollowingthatofitspublicationintheOfficialJournaloftheEuropeanUnion.

6.Abasicinstrumentmayprovidethatif,onimperativegroundsofurgency,thetimelimitsfortheregulatoryprocedurewithscrutinyreferredtoinparagraphs3,4and5cannotbecompliedwith,thefollowingprocedureshallapply:
