成都市市政基础设施项目初步设计审查办法

建设工程初步设计审查是提高工程设计质量、控制工程投资的关键环节，是建设行政主管部门履行行政管理的重要职责。为统筹我市市政基础设施项目建设，进一步规范市政基础设施项目管理和组织实施程序，提高工程设计审批质量和管理水平，依据《建设工程勘察设计管理条例》、《建设工程质量管理条例》、《四川省建设工程勘察设计管理条例》、《成都市投资项目管理暂行办法》等规定，结合我市城乡统筹建设实际，制定本办法。

第一章 总 则

第一条 市政基础设施项目初步设计是依据已批准的可行性研究报告或方案而编制的设计文件，是工程设计的重要设计阶段，是编制施工图设计的依据。

第二条 市政基础设施项目初步设计审查是由建设行政主管部门组织有关部门（单位）和行业的经济、技术专家审查初步设计是否符合国家方针、、法规以及有关标准、规范和规定，是否切合实际、安全适用、技术先进、经济合理。

第三条 成都市市政基础设施项目初步设计审查是按照有关法律、法规规定明确由市建设行政主管部门依法实施的行政审批事项。

第四条 市建设行政主管部门是我市市政基础设施项目初步设计的管理部门，直接负责我市中心城区范围内的市政基础设施项目初步设计的审查工作，并委托高新区负责本区范围内的市

政基础设施项目初步设计的审查工作。

第二章 初步设计审查适用范围和项目分类 第五条 我市中心城区范围内，省市重点市政基础设施项目、投资的市政基础设施项目和有特殊规定的市政基础设施项目，应报市建设行政主管部门进行初步设计审查。

第六条 市政基础设施项目主要包括道路、桥梁、城市隧道、公共交通（公交场站）、轨道交通、给水（供水）、排水（污水处理厂）、城镇燃气（供气）、河道、电力（指电力浅沟、电力隧道）、

第七条 我市中心城区（除高新区）范围内初步设计实行分类审查。

（一）大、中型市政基础设施项目由市建设行政主管部门直接组织审查，审查结果以市建设行政主管部门批复文件确认。

（二）小型市政基础设施项目按照属地划分，由市建设行政主管部门委托项目所在的区建设行政主管部门负责组织审查，审查结果以区建设行政主管部门批复文件确认。

大、中、小型市政基础设施项目设计规模划分标准按照建设部市政公用行业建设项目设计规模划分表执行（附件一）。

（三）以下项目由市建设行政主管部门直接组织审查，审查结果以市建设行政主管部门批复文件确认。

1、市指定由市建设行政主管部门直接组织审查的项目； 2、规划宽度在25米以上（含25米）的城市道路（含与道路同步建设的给排水、电力、燃气、通讯、绿化、照明、交安等附属工程）；

3、其它郊区（市）县与成都市中心城区直接连接的道路等市政基础设施工程项目须报市建设行政主管部门审查。

第三章 初步设计文件编制

第 承担项目初步设计文件编制的设计单位必须具有国家规定的相应资质，工程项目技术总负责人、项目负责人、审核人、审定人及有关技术人员应当具有相应的技术职称或注册资

格。设计单位应对提交的设计文件负终身质量责任。

第九条 工程项目初步设计文件的编制深度和设计内容应满足《建设工程勘察设计管理条例》（中华人民共和国令 第293号）和建设部《市政公用工程设计文件编制深度的规定》（建质[2004]16号）要求。初步设计文件及图纸有效期为一年，如逾期未经规划部门重新认定或者设计文件及图纸不能满足国家颁发的新版技术规范或相关规定的，均应重作设计。

第十条 初步设计必须严格按照批准的可行性研究报告进行设计，不得随意改变建设规模和标准等。

第十一条 工程设计概算是初步设计的重要组成部分，必须如实地反映设计内容和设计标准，做到量价准确，深度应能满足控制投资、安排计划和筹集资金的需要。

概算的编制原则、内容、计算方法、费率和费用标准必须符合国家、四川省和成都市的有关规定，总概算必须包括项目建设全过程所需的全部合理费用，要全面、客观、合理、符合工程实际。

第四章 初步设计审查的申报

第十二条 工程初步设计完成后，由建设单位提出初步设计审查申请，并对送审材料实质内容的真实性、完整性负责，应提交的送审材料如下：

（一）初步设计审查书面申请报告；

（二）成都市市政基础设施项目初步设计审查登记表； （三）项目立项批准文件、可行性研究报告及批准文件； （四）规划设计条件（须明确规划方案及设计边界条件）； （五）需要进行方案设计的项目，应提供方案设计批准文件； （六）初步设计文件（含工程地质或水文地质勘察报告、设 计说明书、工程概算、设计图纸及设计文件的电子文档光盘）；

（七）国家法律、法规规定需要在初步设计阶段完成的影响

初步设计进行审查的专项论证报告，如：地震安全评价报告、行洪论证、通航论证、环境影响论证等；

（八）设计单位资质证书、营业执照复印件； （九）省外设计单位入省备案表；

（十）建设单位与设计单位双方依法签订的合同文本复印件。

建设单位报送初步设计文件时，应会同设计单位向主审部 门汇报工程及初步设计的有关情况和存在问题。主审部门应在接到初步设计审查申请报告后三个工作日内确定工程是否具备审

第五章 初步设计审查的方式和内容

第十三条 市建设行政主管部门和五城区建设行政主管部门负责组织相关部门（单位）和专家以会审方式按照我市中心城区（除高新区）范围内初步设计分类审查要求对市政基础设施项目进行初步设计审查，具体采用行政审查与技术审查相结合的方式。行政审查主要是相关部门（单位）按照各自职责进行综合审查，对初步设计是否符合部门（单位）管理要求提出审查意见，相关部门（单位）会审不到场或在规定时限内不作答复的，视为同意初步设计报审内容；技术审查是专家对初步设计涉及的技术规范、标准等内容提出审查意见，对于规模较大及特别重要的市政基础设施项目，还应根据其实际情况进行专家预审，预审通过后，再进行初步设计审查。

第十四条 计划、规划、城市管理、消防、环保、水务、林园、交管、人防、文物、地震、供电、供水、供气、通讯等主管部门（单位）以及相关专业的专家参与各级建设行政主管部门主持的相关项目的初步设计会审。为防止重复、多头审批，未经建设行政主管部门同意，其他专业主管部门不得另行组织初步设计会审。

第十五条 初步设计审查主要内容按照主管部门（单位）和专家审查内容的不同分类如下：

（一）主管部门（单位）审查内容:

1、核查工程建设规模和内容与市、区有关部门批准文件的符合性；

2、核查设计是否符合国家和地方的经济发展及相关部门管理规定；

3、核查设计方案是否符合城市总体规划要求。 （二）专家审查内容:

1、核查设计执行国家和行业强制性标准情况以及是否符合国家及地方有关技术标准、规范、规程及规定的要求；

2、核查总平面布置、主要工艺流程、设备参数与配置数量的合理性；

4、核查工程施工条件、方法和进度的合理性，确定工程工期；

5、对初步设计方案提出优化措施，对工程概算提出调整意见；

6、核查工程概算的编制依据和方法、工程概算内容和取费参数的合理性，严格控制工程建设投资规模；

7、核查消防、环境保护等涉及公共安全、公众利益的工程措施执行相关标准规范情况；

8、核查照明、交通安全设施、绿化及城市家具等配套工程的完整性、合理性。

第十六条 符合审批条件的市政基础设施项目，审批机关原则上应在召开审查会议后的五个工作日内，下达初步设计批复。

第六章 初步设计的变更管理

第十七条 初步设计批复是施工图设计的依据，初步设计一经批复，施工图设计要严格按批复执行，不得擅自扩大（减小）建设规模，增加（减少）建设内容、提高（降低）建设标准。初步设计中主要内容的修改必须报经原主审部门审查同意。

第十 初步设计批复后，必须严格执行，任何单位和个人不能擅自变更。因以下原因确需变更的，应重新进行初步设计并重新报审，其中变更幅度超过项目建议书、可研允许的还须经投资主管部门同意：

（一）因国家、省、市级重点工程建设，土地利用总体规划依法调整，文物保护、地质影响等导致项目初步设计变更或项目

区地块用途改变的；

（二）项目实施中，主管部门对项目的要求发生改变导致初步设计变更的；

（三）因自然灾害等不可抗力造成难以实现设计用途的。 第十九条 设计变更应先批后变，与初步设计审查批复精神不一致的设计变更方案要由建设主管部门重新组织审查批准后方可实施。

第七章 罚则

第二十条 对于按规定应进行初步设计文件审查而未报经审查的或擅自修改工程设计文件的行为，依照《四川省建设工程

第八章 附则

第二十一条 抢险、救灾、维护项目及其他临时性项目，不在本办法要求范围之内。

第二十二条 其他区（市）县建设行政主管部门可根据本办法的精神，结合当地实际制定加强市政基础设施项目初步设计审查管理的具体办法，负责权限范围内本行政区域内市政基础设施项目初步设计审查工作，市建设行政主管部门负责对其进行业务指导，以切实提高我市市政基础设施项目初步设计审查管理水平。

第二十三条 本办法由成都市城乡建设委员会负责解释。 第二十四条 本办法自2011年6月20日起实施，有效期5年。原《成都市市政基础设施重点建设项目初步设计审查办法》的通知（成建委发[2005]218号）同时废止。

建设工程初步设计文件编制要求（简述）

一、初步设计文件根据设计任务书进行编制，由设计说明书（包括设计总说明和各专业的设计说明）、设计图纸、主要设备及材料表和工程概算四部分文件组成。

在初步设计阶段，各专业应对本专业内容的设计方案或重大技术问题的解决方案进行综合技术经济分析，论证技术上的适用性、可靠性和经济上的合理性，并将其主要内容写进本专业初步设计说明书；设计总负责人对工程项目的总体设计在设计总说明

（一）勘察报告、初步设计文件均须具备扉页即工程勘察设计人员签字页，加盖成都市建设工程勘察设计文件（出图）专用章（设计说明书和概算说明书分别装订时，须分别具有）；

（二）初步设计文件扉页须包括总建筑师、总工程师、项目负责人、各专业审定人和各专业负责人的名字、职称、注册情况，名字须同时打印和手签，注册人员应加盖注册章（设计说明书和概算说明书分别装订时，须分别具有）。

（三）初步设计图纸均须加盖成都市建设工程勘察设计文件（出图）专用章和相应注册师印章，图角须包括设计单位名称、工程名称、单位工程名称、图纸名称、设计号、图别、图号、日期、项目负责人、审定（人）、审核（人）、校对（人）、设计（人）、制图（人）、工种负责人等栏目，人员名字须同时打印和手签。

（四）勘察报告的扉页和钻孔布置图等图纸的图角参照初步设计文件执行。
